Legal Question in Personal Injury in New Jersey
PLease give the right solution
After being charged with a Personal Injury Law Suit, which I believe is totally bogus in nature, How can I defend/Getby this charge after a motor vehicle accident in Nov02.Police Report says my fault and I had no Insurance at the time of accident.Plaintiff's lawyer is asking for Justice for the damages( No Amount is shown in complaint),or anyother Insurance details,also that she will have to incur Hospital Bills etc..
What would you suggest..I can't afford a lawyer to defend myself..iF i FILE bankruptcy, will it stop..Moreover no Lawyer is sure about the result which would further result in more fees and more uncertainty..How far this case can go??

Without knowing the facts, no one can advise you on whether it is better to try to defend the Plaintiff's suit, offer a settlement that you can afford, or file bankruptcy. Bankruptcy will make the claim go away, unless you were under the influence of alcohol or drugs, but you may have to surrender assets if you have any in excess of the exempt amounts. You need to consult with a lawyer who can review all the facts and advise you.

Defending the lawsuit is the first step in the defense analysis. It is not simple to win a lawsuit in personal injury in Court. Indeed, there are hurdles for counsel to get over and there is always an appeal if the Court with jurisdiction over the case is the general district court. We can always use the issue of a pending bankruptcy to negotiate a settlement to a judgment, if any, but this always comes after we analyze whether the suit has merit or not. Too many unrepresented parties analyze the after effects to a judgment without spending enough time analyzing the first issue of liability.
