Legal Question in Personal Injury in New Jersey
Hi,
A year ago, my father, while driving, accidently hit a kid riding a bike. It was a low speed impact. The child was taken to the hospital for precautionary reasons but was not hurt, except for maybe some scrapes and bruises. My father said that he went on green light and did not see the child. Witnesses, he believes were simpathetic to the child, said he went in the red light which is what the police report says. The child was not wearing a helmet. My father recently received a letter from his insurance company saying to prepare for a law suit. He has $100,000/$300,000 liability on his auto insurance. He is 77 years old and concerned about his life savings which he needs to live on. Anything he can do to protect himself?
Thank you,
Jay

The insurance company with provide an attorney for your father and does not want to pay a penny more than it has to. Unless the child has permanent, significant impairment of his mental
and bodily functioning, your father probably has enough coverage.
As for protecting your father's assets, you should consult with another attorney. I do not give such advise.
