Assuming you are referring to a contingent fee, in New Jersey it is a sliding scale, generally net of expenses; 1/3 of the first $500,000, 30% of the next, 25% of the next and 20% of the next with any fee on recovery over $2,000,000 determined by the court.

For minors it is a flat 25% of the recovery unless the case is tried, then it follows the other schedule.

Your attorney must give provide a written retainer that provides this information.

Assuming this is a personal injury case, Mr. Rothenberg is correct. If it is another type of case that it depends on what the fee agreement states.
