Is legal representation necessary when a pedestrian is injured

A friend was crossing a NJ street and was hit by a car in the middle of the street. Considering the police report bears out the fact that the driver, who remained at the scene, was ''in the wrong'' can the injured party expect an offer from driver's insurance co., or should a lawyer be retained?

Legal representation is not necessary but more likely than not if your friend retains an attorney the full value of his case will be achieved. The carrier will try and settle for a low value with your friend because he will not have the experience of knowing the values of cases of his type here in New Jersey. While you can expect the insurance company will eventually make an offer you can expect that without legal representation any offer made will be much smaller than an offer of settlement should a lawyer be represetning the family.

Retaining an attorney to represent you (or your friend in this case) almost always benefits the injured party and will generally result in a larger settlement for the injured person.

Insurance companies do not have the injured person's rights in mind as their primary objective. They are out there to make money. The less they pay to injured parties the more they make!

Your friend should contact an attorney sooner rather than later and should not speak with the insurance company without one!

Without reading all the replys to your question, I will assume that everyong says retain an attorney. Although insurance carriers on occasion do offer reasonable compensation for personal injuries due to their insured's negligence, an insurance carrier will likely try to settle quickly to avoid paying the full value of your friend's injuries. I recommend retaining an attorney to assist in all aspects of your friend's case.

I always recommend that an injured person have an attorney because my experience is that the insurance companies try to take advantage of people who do not have attorneys.

The value of the case depends on the nature of the injury (pain and suffering) and other consideraitions such as lost wages and out-of-pocket expenses.
