Exactly who is liable?
In 2000 I was injured in a machine accident at work. The machine I operated did not have a guard at a point of contact. This is the tricky part. The company which made the machinery filed for backruptcy years before my injury and was bought by another company who merged with another company. My question is this, plain and simple. Who is liable for the machinery? Does liability end after bankruptcy or because the company was sold is the machinery now the responsibility of the new owners? I have a few more questions unfortunately not enough space.

I recently had a similar product liability case where, although the company went bankrupt, the insurance policy that the company had prior to going bankrupt was still responsible to pay. This may very well be the case here. Furthermore, it may be possible that the successor company may be liable. Of course, I need to learn about your situation in order to make any definite conclusions.

If the bankruptcy occurred before your injury and the company was purchased by another subsequently, they have may have purchased the liabilities of the predecessor company and may potentially be liable to you.
