Legal Question in Personal Injury in New Jersey

My niece was shot by 2 men in her home who then stole her car. The police found the car and then the guys who stole it. They checked it for evidence and now we just found out that the car is in a New Jersey auto body shop and we have to pay 500.00 to get the car back. We should our family pay for a car that was towed for evidence? We were never told that we would have to pay to get her car back. Is there anything we car do to get this fee waived?
