Legal Question in Personal Injury in New Jersey
I am a NJ resident and I was on my way to PA for a business trip. I am a salary paid full time employee of the company with full benefits. In PA while I was en-route to the company's manufacturing plant my car was rear ended by a truck and the front was hit by a christmas tree that fell off a truck in front of me (we do not anything about the truck in front of me as he drove away). As soon the accident happened I called 911 and asked for an ambulance because I had upper back and neck pain. The police wrote the police report and I was taken to the hospital. At the hospital it was found that I had no major injuries, just muscle pains.
My car obviously was totaled. Prior to the accident the car was in excellent condition with low miles. All the maintenance was up to date, with brand new tires ($650), and absolutely no scratches on the body.
What are my rights because my car was totaled by a commercial vehicle.

The insurance policy on your car has uninsured/underinsured motorist coverage for accidents in which you are injured or suffer property damage to your car, with another vehicle which has no
insurance; hits and runs or is underinsured. You must make a claim under the insurance policy upon your vehicle. If you will review underinsured/uninsured coverage on the declaration page for your car insurance you will learn the limitation of property coverage for your policy. The same is true for any bodily injuries which suffered. You must make this claim immediately.
