Legal Question in Personal Injury in New Jersey

Personal injury matter

I was critically injured in a car accident in alabama in january 2007. I live in new jersey. Do i have to have an alabama attorney to litigate this matter or can i retain a new jersey lawyer since this is where i reside?

YOur best bet is to retain a NJ Attny to guide you and have the NJ Attny connect with the Alabama Attny. This happens often. Generally, the NJ Attny can help witht he medical issues locally, while the Alabama Attny handles the court room issues. Remember that not all cases end up in court. Call me if I can help.

You will need an attorney in both, but here is the good news: both attorneys will be able to take the case on a contingent basis--which means you don't pay unless you win. We frequently have occasion to work as New Jersey counsel with counsel out of state. You will need an attorney in Alabama to file and process your case but local counsel can make it easier.

You may need to hire an attorney in NJ and Alabama but sometimes if the facts are right and things are done well before the usual two-year statute of limitations, then the matter may be handled by NJ counsel. If not an NJ attorney would assist you in understanding the legalities of the Alabama laws and the terms of hiring the lawyer there as well helping to find a lawyer there with you. You would definitely need to determine whether notice requirements are met in accord with Alabama law. These issues depend on the person or entity responsible for your injury. A NJ lawyer might also evaluate the potential liability questions and assist you with dealing with your NJ auto insurance that would be responsible for your medical expenses in most cases regardles of whether the driver was at fault.
