Legal Question in Personal Injury in New Jersey

rear ended, might change lawer

about 5 months ago i was rear ended while waiting at a red light.my car was totaled - $16200 paid for it from the insurance company of the at fault driver. so far i have a little over $5000 in medical bills due to pain in the back, the neck, sleep disorder, headaches.MRI showed no herniation but i'm still in pain.my doctor says it will be at least a few more months of therapy until i fell better.my problem is my lawer-he is very hard to reach,arrogant and because from i understood his major is criminal law - not able to answer my questions.my biggest question is how much approximately my case could worth under the given conditions. and if i decide to get a new lawer what should i pay my current one.

I cannot criticize your lawyer for not telling you how much the case is worth, because unless he is paying, it is worth what a jury tells oyu or the defendant offers.

On the other hand, it appears that you havea threshold case htat requires you to show objective proof of a permanent injury; without that proof and an affidavit from the treating doctor, the case has no value. The task is to show the injury and obtain the proof. This is why you should chose an experienced personal injury lawyer. We can attempt to assist you, but it will be up to the doctors to do testing which shows the injury. If you have a head injury the next step may be to get you to a neurologist or neuropsychologist to do the testing.

As to changing lawyers, if you are on a contingent basis you can change anytime. Payment for services to date or worked out between the lawyers and they split the fee as agreed. There is no additional cost to you so no need to pay. If you hired them on an hourly basis, then you owe them the time they spent.

there is no way to determine the value without looking at the medical records and speaking with you. Your present attorney will be paid by your new one. You need not worry about that
