Legal Question in Personal Injury in New Jersey
Rearended by Alleged DUI Driver
My family was recently rear ended by a driver who was ticketed with DUI at the scene. We didn't sustain any serious injuries although everybody in our car is complaining of stiffness and neck pain. None of the passengers in our car went to the hospital immediately after accident.
Our car is likely totaled as the driver didn't apply the breaks or even swerve to avoid our car while we were stopped at a red light.
I'm looking to make certain that we are covered in the event of any medical issues that arise. I'm also looking to make sure that we are justly compensated for the vehicle and that we are not held liable for any repercussions (financial, legal, or insurance related) due to this incident now or at a later time.
What are my rights at this point? Should I be consulting with an attorney to make sure we're doing the proper things?
Thank you,
Adam

Re: Rearended by Alleged DUI Driver
Dear Adam:
Should it turn out that you or any of your family members sustained a significant injury requiring treatment, it is possible that this firm could pursue a claim; not only against the driver at fault, but possibly against the establishment where the drunk driver became intoxicated.
We hope your family does well and fully recovers. However, if you need to call us, please do. We'd need additional information in order to evaluate your potential claim.
Please feel free to visit our website and contact me or any of my partners at the Blume Goldfaden Firm via the profile information provided on this site. If you need us will assist you in any way we can. This firm has handled thousands of similar cases. We do not charge any legal fee until and only if we secure a recovery on your behalf.

Re: Rearended by Alleged DUI Driver
you do have some recourse for your property damage as well as potential injuries. most likely your case will qualify to be taken on a contingency, which means you dont have to pay us unless we receover an award for you, in which case, we would take a percentage of that award. please call me for a free consultation.
Re: Rearended by Alleged DUI Driver
You all have the right to recover. Check your insurance to see if what type of coverage elections were made, and then get in touch with an attorney who will charge a contingency. For example, my firm charges a fee of between 20% and 33% (depending on the size of the recovery) at the conclusion of the case. After you see what other lawyers will charge, if you are interested in discussing the case, get in touch.
