Rear-ended Settlement
I was rear-ended on the Garden State Parkway in June. There was minimal damage ($850) to my vehicle because the accident occurred at a very low speed (25mph). I felt fine initially after the accident, but later in the evening I experienced severe pain in my neck and back. I went to the doctor and had an x-ray performed. Nothing was uncovered, but I was referred to a physical therapist for treatment of my pain. After 12 sessions (3 months later) I now feel better. The insurance adjustor offered me $500 for my pain and suffering. This seems unreasonable since I was in pain for over two months. In addition, I had to make changes to my life style (couldn�t run, bike ride, etc) as a result. Is there some mathematical formula ($ per day X # of days in pain) for this type of claim. I would prefer to settle this claim without hiring an attorney. Thanks.

There is no formula. It all delpends on the severity of the injury and any degree of permancy. While the offer is on the low side it is not totally unrealistic. Try to nudge it up a bit, settle & avoid a small lawsuit. When you have a serious accident call me. Good luck.

Trying to be your own attorney is penny-wise and pound foolish. Studys show that when you have an attorney, your 2/3rds will generally be greater than 100% of the little pies or bones that the insurance company will throw at you.
