Legal Question in Personal Injury in New Jersey

Recently I got hit in a car accident. The owner of the vehicle that hit me, and stated he was at fault, and it was document in to accident report. My car was just declaired totaled. They are providing me with a $6,000 dollar check, which they state is the value of my vehicle. Currently I had on year of payments remainding on the car, before the car would have been paid off, which total $3,000. My question is, can I sue the person that hit me for the $3,000 that I have to use towards the finance company?
