I am 52 YO, riding my bicycle in Metuchen NJ. The sidewalk was raised almost a foot because the township took out a huge tree leaving a dangerouse condition for the past 6 months. I do have a police report indicating that I could not see this and I could cause serious injury. Who is responsible for my injury?

Thank you for your inquiry. If the tree was removed by the Township, and the sidewalk maintenance in that area is the Township's responsibility, then you may be able to commence a suit for your injuries against the Township. If the sidewalk maintenance is the responsibility of a private individual or business, you may be able to pursue an action against those entities. Please note that there are strict time requirements which must be met if an action is to be commenced against a Municipality (as little as 90 days from the date of the accident to file a Notice of Claim). My firm has handled numerous suits of this nature against various municipalities. Please feel free to call me or one of my partners at Blume Goldfaden to discuss your potential claim. (973)635-5400.
