Legal Question in Personal Injury in New Jersey
Being sued by a client
My husand has a sole proprietorship (construction) and he is being sued by a client who brought his wife to the jobsite in the dark. She fell and was badly injured. Can we lose our home, since they are suing for more than his insurance covers ($5000,000)? In addition, I suspect he may have been trying to kill his wife, since she is in her 60's and he brought her to an unlit construction site after dark. How can we bring that to light? We were advised to get a personal attorney in addition to the insurance company lawyer. Mostly, I am afaid that we will lose the beautiful new house we are building after 21 years of marriage. Our present home is in my name which my husband signed over to me 4 years ago. We have an $80,000.00 home equity line in my name also, which we are building our house with. Thank you for your time.

you can lose everything unless it is handled right. As an insured, you have certain rights under your insurance policy. You need to protect yourself from the plaintiff and the insurance company. YOu need to hire an attorney to represent you personally. The insurance company must have notified you that the claim for damages is in excess o fyour policy, they should have advised you that you need personal counsel.

I agree with the other attorney, Scott. You need to hire an attorney to defend you. Yes, this could be bad.
You need an attorney reasonably near you who does a lot of civil litigation.
It sounds like just a crazy situation. Fight back and protect what you have worked so hard for.
