Legal Question in Personal Injury in New Jersey

Being Sued

My nephew had ins. and he was in a situation where he paniced with some friends who had drugs on them and a police officer was pulling him over. He made the biggest mistake by not pulling over so he eluded. Now during the corse of him eluding a pedestrian was injured and the insurnce won't pay due to a clause. I would like to know

now he's gonna get sued. He has no assts of any type. He doesn't even have a job so when he works will they garnish his pay and he's talking about filing for bankrupcy. We know the suit will be for a large amount and he won't be able to pay it off so fast but can u give me some insight please any response will be appreciated.

he should consider filing for bankruptcy as soon as possible, because the law will change very soon. the bankruptcy will deal with the law suit. If a large judgment is entered against him, and there is no insurance coverage his driver's license will be suspended until he either paysoff the judgment or proves to DMV that he is complying with a court authorized payment plan that will payoff the judgment. Most of these problems can be avoided via bankruptcy. Also, I have extensive experience in criminal law. He will be charged with second degree eluding. He faces a minimum of 5yeas to a maximum of 10 years in state prison, unless he is properly represented. Also, if drugs were found in the car, he faces drug charges, license suspension and thousands of dollars in fines.
