can i sue a private investigator who is propagating that i am exaggerating my injuries and that the accident never happened to me even when the insurance company agreed to a paid for all my injuries and I have depositions of coworkers who confirmed the events

It is quite appropriate for an insurance company to hire a private investigator to look into a claim. Presumably, once the trial occurs, the PI will testify as to what he observed in the course of his investigation. Prior to the trial, however, your attorney will be able to get information concerning what the PI will say at the time of trial. This is called "discovery." If there are weaknesses in his testimony, it can be countered as part of your litigation strategy. I am not sure exactly what he is saying that makes you believe that you have a cause of action against him. The advice that I am giving you is based purely on the little bit of information that you have given to me. There may be other factors that would change my opinion or would establish a cause of action. Further, no one can rely on advice from an attorney who has not been retained.
