Legal Question in Personal Injury in New Jersey
trespassing and injury
a woman sits on my parents' fence though they have asked her not to. Their concern is that if she breaks the fence by sitting on it, and injures herself, she will hold my parents liable. Would she have a case and how can my parents protect themselves?

If its a dangerous condition, possibly nothing. However, I doubt the fence is that dangerous. You could send a certified letter to her warning her not to sit on the fence as it is not safe to do so. Finally, you could file criminal charges against her or threaten to do so.
