Legal Question in Personal Injury in New Jersey

I was walkingto the busstop after work at midnight. Next thing I knew my stomach was bent over the curb with my upper torso in the street. A car quickly swerved out of that lane and continued. My palms had slight abrasions from catching the fall. My pantsleg had surrounded this six inch high metal stake ( used to screw a roadsign post into) ; which pinned movement of my foot and threw me. When I got home my back felt twisted and sore when I breathe in deep. Through the pain I finally fell asleep. I woke up feeling sharp pain whenever I bend forward. This will cause difficulty doing my job today. (Deli worker) ; but I cannot afford to miss work. Does the town have any responsibility for leaving something unsafe there? How can I prove that the nick on my ankle and hand bruises are from that? Am I wrong for going back to work today if I don't know the seriousness of the back injury? Or; how long could I wait to see if it gets better naturally before starting a case against them if I need serious medical treatment?
