Legal Question in Personal Injury in New Jersey

Written answer or Motion

How do I go about answering a suit that has been filed against me, my wife and my 17 year old daughter, in reference to a dog bite case, and can a lawsuit be filed against a minor?

Re: Dog Bite Lawsuit

If you have homeowner's insurance that should cover the

alleged loss. Dog bites (in most cases) are strict liability so you should

contact your insruance agent and tell him/her about the suit. The insurance carrier will assign an attorney to file an Answer on your behalf.

If you do not have coverage, you can either answer the law suit prose or hire an attorney to represent you.

Minors can be sued. Their level of care is that of a minor of that age.

Hopefully you have homeowner's insurance that should cover the alleged loss. If you have insurance, call your agent and tell him/her about the suit. He/she will tell you how to proceed.

If you do not have coverage, you can either answer the law suit "pro se" (on your own) or hire an attorney to represent you.

Good luck.
