Legal Question in Real Estate Law in New Jersey
My 101 yr old Mom is bed ridden with alzhemiers
My sister and I have been supporting her in her own house for six years. She has no money. We went to Court six years ago to get Guardianship plus I have a Power of attorney. We want to sell her house which is her name to get some money, and put her into my brother in laws apt. We have a contract on the house but need help on how to proceed with signatures & most important, is it legal to do this on our own. We sold it without Real Estate. Thanks for your help. We are desperate for help.

You really need to seek a consultation with a local real estate lawyer, to whom you disclose all of the facts and documents. I don't understand what you mean by "We sold it without Real Estate." You may ask the buyer's title insurance company what it requires from you. There are also issues in planning for your 101 yr old bed ridden Mom with alzheimers, which may require consulting with an Elder Law attorney. A short consultation shouldn't be too expensive, and perhaps there is low or pro-bono law firm or clinic that will help you.
Good luck.
THIS RESPONSE IS NOT LEGAL ADVICE, SINCE I DO NOT HAVE ALL OF THE INFORMATION THAT WOULD BE REQUIRED, AND I DO NOT HAVE A REPRESENTATION AGREEMENT WITH YOU.
* If the answers to your question confirm that you have a valid issue or worthwhile claim, your next step should almost always be to establish a dialog with a lawyer who can provide specific advice to you. Contact a lawyer in your county or township.
* Another reason for contacting a lawyer is that it is often impossible to give a good answer in the Internet Q&A format without having more information. The unique circumstances of your situation and things that you may not have thought to mention in your question may completely change the answer. If you want to be sure that you have a complete answer to your question and an understanding of what that answer means, establish a connection with a lawyer who practices in the area of your concern.
