Legal Question in Real Estate Law in New Jersey
Abadoned Property
My dads girlfriend lived in our house for about five years, she slowly just stopped coming here, she never offically moved out, but all her stuff is still here (3 rooms of stuff) she really hasnt told my dad anything, her stuff has been here for over 3 years, except a couple of months ago she told his brother she might be getting a house, what can we do? i have already packed some of her stuff and some of it is broken. What are our rights? can we sell it. should we notify her?

Re: Abadoned Property
The safest thing to do is to treat her as if she had been a tenant (even though the fact might be different). The statutory law provides for a method of notifying a tenant about their rights concerning property that they have left behind. After a proper notice has been sent, the former tenant has thirty days to remove the property or it can be disposed of or sold by the landlord. To avoid hurt feelings, your lawyer can also send a letter explaining why the notice is necessary.
My firm does work related to property management. You didn't give your Zip code, so a can't tell if you are close. If I can be of further help to you, call or email.
