Legal Question in Real Estate Law in New Jersey
I am looking for an answer to this question, 2 of my brothers want to sell my fathers house. My father recently passed away and another brother lives there. Can the 2 older brothers sell the house from underneath myself and the third brother?

It depends on what the will says, but if the house was left to all of you, all of you have to sign off. If it is part of the estate, the executor can sell it, but has to divide the proceeds among all of you after paying all the bills. No, they can not. But that is not the end of this. If your father left a Will, the whoever got the house will be the owners. If all four of you own it together, then they can go to Court and force the house to be sold. You need to talk to a lawyer and get some advice.
