Legal Question in Real Estate Law in New Jersey

Bill to Quiet Title

A recent real property title search for a piece of property I wish to purchase shows several parties' names whose properties at one time adjoined one I will purchase. The title search found other parties dating over 50 years ago (who in all likelihood have long since passed on, nor no longer reside or currently own property adjoining the property I seek to buy) and the researcher suggested a “Bill to Quiet Title” would be necessary to clear up any ownership issues or claims. As a Pro Se Plaintiff I hope to have a judge rule on this and grant a “Bill to Quiet Title” but am not sure what Chancery Court document I need to file for Somerset County, New Jersey. Do I submit a ''Civil Complaint'' or ''Motion for Summary Judgment'' or some other document? Further, as the other parties mentioned above are known only in name with no current address, how do I cite the remaining parties as Defendants beyond their names alone? I have been told that I would need to put an ad (notice) in a newspaper and run it for 60 days to bring attention of this matter to these parties and address any claims they may have. At what point is placing the notice done relative to the submission of documents to the Chancery Court? Thank you.

What you have is a very complicated legal matter. You need to seek legal advice. It would not be possible to answer any of your questions without reviewing the title search. While it may cost you now for an attorney, it will cost you even more later if you try this on your own. Please call for an appointment. If you mention Law Guru the first half hour is free.

1. Hire a lawyer; or

2. Go to law school then spend a year or two in a firm that handles real property.
