Legal Question in Real Estate Law in New Jersey

My ex and I bought a home together In 2008. We broke up and she left in late 2008. I have been paying the mortgage myself since then. She put 10000$ of the down payment down. We cannot refinance because we owe more than the house is worth and I do not have an extra 50,000 to pay to have her name taken off the deed. Now she wants her down payment back. Do I owe it to her even though I've paid the mortgage we both agreed to pay by myself for the past 3 and a half years? Also if I pay her will in be beneficial for me to get her to sign over her part of the deed? We both want her off the mortgage and the deed and if we sell we will both owe money and honestly I've started a family in this home and want to keep it. Any advice ?? Thanks so much. Ryan
