I am breaking my lease in NJ early due to possible layoff for my husband. He was able to find a job out of state. We have 4 months left in our lease. We are also eager to leave the property because we've had to file a police report regarding my rent check being stolen by my landlords tenant. So now I'm also dealing with ID theft..(the tenant stole it from my landlords mailbox?) Assuming the landlord can find a renter by the time we leave and there is no lapse in rent should we expect our deposit back (1.5 months rent)? Thank you in advance.

The landlord must send you an accounting for the security deposit within 30 days.

In the State of NJ the Security Deposit can only be applied against damage not rent.
Regarding when you can expect the return of the money the Landlord must return the deposit within 30 days of the time you have surrendered the premises but you may not receive the full amount if the premises were damaged. Best regards, Keith Singer, Esq. 732-749-3700
