Legal Question in Real Estate Law in New Jersey

compensation for easements

I want to subdivide some of my property and give the parcels to my children to build on. My application will be rejected because I am not giving the county a strip of land in form of an easement. Since I purchased the land I would like to be compensated for the land they demand. Do I have a right to any monitary compensation

Re: compensation for easements

You do not say what type of easement they are requesting? You may be entitled to something, or you may not, depending on what they are requesting for approval. Are new roads involved, entry required for fire and safety access, utility and sewer connections and access or anything similar. These are not probably compensable. And you may also need Planning or Zoning Board approval, and other conditions may be imposed. This should probably be reviewed with a Land Use attorney who does sub-divisions regulalrly.
