Re: Condominium law under New Jersey NJSA 46:8B-24
We have an outstanding $105K insurance claim against the Condo Association where they have not adequately responded since the Insurance company put their settlement "on the table" 10/22/09. Fire damage occured 7/3/09.
Our question is does the law give the Association the exclusive right to make and control the repairs? We as home owners engaged a contractor that started work yesterday, but last night the COA Board's attorney has ordered us to cease and desist all work. Our complaint is not about their "right" but their responsibility and obligation to perform.

Your question is actually a lot more complex than you may think it is. My initial impression is that you are unwise to start any repairs until you are sure to have the money in hand unless there is an emergency.
