Legal Question in Real Estate Law in New Jersey
Condominium By Laws - Amendments to same
We would like to change one of the by laws in the condominium complex where we are owners. Right now we are getting little to no cooperation from the Board of Trustees and we feel our right to address this change is being violated.

The By-Laws should contain a procedure for raising a question and getting it to the owners for a vote. Check the procedures. If none, you may want to attend a meeting and, possibly, get a petition signed from owners to put the question on a ballot for the annual meeting or any meeting where owners get to vote. Check one item. In many instances, some by-laws are required by municipal ordinance and were adopted as part of the municipal approval process. These by-laws cannot be chganged by owners, but require a change by the planning board of the municipality.
