so confused over what a life estate is
I thought a life estate was simply a person owns a house and passes title deed of property to a remainderman. the person can live in the house until death. then the remainderman becomes the owner.
I don't understand life estate tables or taxes on a life estate. Also when this life estate was created over 10 years ago, lawyer stated its not to be put in the persons will. Went to 2 different lawyers and both said conflicting info. one said that Im going to have problems because a gift tax form was never filled out. the other said the life estate has to be stated in the person's will. I need a lawyer that can be straight forward and direct and well versed with life estates. can someone here advise me

A life estate is usually a reserved interest in a house when title is transferred to another (for example between a parent and child). The Deed transferring the ownership spells out that the Grantor (person transferring) is transferring ownership, but reserving the right to continue to live in the house until some specified time (death, incapacity, downsizing, etc.). There are many issues that should have been covered at the time of the transfer, such as who has the responsibility to pay bills (like real estate taxes, homeowners insurance, mortgage, if any, repairs and maintenance, etc.), and what happens if the person retaining the life estate has to move. Also, the transfer is a gift and should have been reported as such, even if no gift tax was incurred or had to be paid.
