Legal Question in Real Estate Law in New Jersey

Contractor builds new home without a liscense

My husband & I along with a contractor filed for a const. loan/mortgage-the mortgage co. ok'd all const. of our new home. When our home was finally completed we were waiting for our CO,however we were informed that we could not get one without a HOW warranty, I had to sign the permits in my name(the builder told us to) in order to get into our new home (we were already at the deadline date) and we were going to have to pay alot of interest. He is not a lisc.builder or reg. with the state. We have no HOW warranty and there are major defects with our home-Please someone shed some light on what am i to do?

I generally prefer to give more specific answer to questions, but in your case, I can only suggest that you review your situation with a local attorney with experience in real property/construction law. You need to determine, as quickly as possible, who you may have claims against, and present those claims. If necessary, you may have to sue, and you must sue within a certain time. You don't want to miss that deadline. Good luck.
