Legal Question in Real Estate Law in New Jersey
How do we correct deed now that we're married?
My wife and I bought a house before we got married as tenants in common in New Jersey back in 1992. We married in 1993 and never corrected the deed for the name change and to change from tenants in common to JTWROS. What is the quickest, least expensive way to do this? Thanks for your help in advance!

Almost any lawyer would be able to draft a deed and arrange to have it filed for you. You need to contact one. If you do not know any lawyers, feel free to call me at 856-546-8010 and I will be happy to assist you. Rob Gleaner

Easiest way is to record a new Deed, indicating you are tenants by the entirety (JTROS between spouses). All it costs is Deed preparation and recording fees (no recording tax to change). I would charge $60.00 plus recording fee (about $40) to assist you. Also, consider if this is necessary. There may be reasons (e.g., estate planning) where tenants in common may be preferable.

Both of you may sign a deed from yourselves as tenants in common to yourselves as husband and wife, and make the title "tenants by the entireties", which means the same as jtwros, but is available only to married couples.
A local real estate attorney could prepare the deed and other documents needed to record it, you would sign and acknowledge in the presence of a notary (notarized) and then you would take it to the county seat (from your zip code, sounds like Camden County, where the County Clerk's office is in Camden) for recording.
