Legal Question in Real Estate Law in New Jersey

My daughter found an apartment and paid the rent and security to the landlord's assistant. She did not sign a lease. She stayed for one night and did not like the apartment. Now she wants to get her money back and tried texting the assistant. The assistant is slow in getting back to her and says that she is trying to find someone to rent the apartment. She has not replied back to my daughter as yet. Can my daughter get her money back?

Even with no lease, she is still liable for the first month's rent. The landlord should account for the security deposit within 30 days.
