Your wife's estate is entitle to the benefits of her ownership interest in the partnership. Exactly what that means depends on the content of the partnership agreement and how much it leaves up to the NJ partnership law. Assuming that you are the representative of your wife's estate, you should have a lawyer review the agreement. If you do not have a copy, there are ways that one can be obtained from the remaining partners.

Your wife's estate is entitled to her share of the partnership, but her estate has to be probated whether or not she had a will. Request a copy of the partnership agreement. Take the agreement to an attorney. If you cannot get the agreement, see an attorney immediately. If you would like an appointment, mention Law Guru and the first consutation is free.

As you can see from the other attorneys' replies, this will take a bit of work to get moving. You will need to probate her Estate, and then take action to deal with her partnership interest. It is going to be difficult to do without a lawyer's help.

Give me a call, make an appointment to come see me, and let's get moving on this for you. No charge for the telephone call and no charge for the first office visit.
