Legal Question in Real Estate Law in New Jersey

We own a duplex that is owner financed. The four of us are on the deed. My husband and I would like to split our deed with the couple downstairs and make it into two separate homes. We live upstairs and they live downstairs. Would we be able to split the deed without them agreeing to it?

If they don't agree, there are options you have but it is likely going to have to involve going to court. Unless you hire a big firm, which could cost big money, you may actually need at least two different attorneys as you are going to run into zoning issues. This is a multi-step issue where you first have to get them on board and then you will likely have to work on the zoning issue after that. You could also buy them out and turn them into tenants.
