I have been informed from the township I live in that they

want to get and easement on my property and take 3750 sq ft

they will go with eminent domain. what are our rights to this situation, I we agree we will loose and future value of our land and will be unable to ever sell our home. this is surposed to be our retirement home for life. need all the help we can get. please ans asap

Re: easement

It is quite possible that the town has an easement which would allow it access to go forward with the project. If they don't, you may be able to contest an eminent domain proceeding, depending on any number of circumstances. In my opinion, however, you should retain an attorney. If you have a survey take it to a local lawyer (preferably with contacts in the municipality). He or she will discuss your options. My colleague Jane Herchenroder, Esq., in Somerville, 908-231-9222, is a good place to start, if you don't know where to go. Best of luck.
