Electric Company Easement

When I bought my property I knew

the Electric Company had an

easement one side and was told they

had it for about 30 years. Where

would I find a document that shows

which electric company holds it and

what is allowed? And is there any

chance of having it removed?

I agree with Richard and John in their replies. I offer an additional suggestion from a recent transaction with a client. While the easement cannot be removed, without the consent and approval of the power company, it may be that they no longer need it. In my client's case, not only was it no longer needed, they actually afforded him the opportunity to purchase some contiguous land, which he did. This not only ended the easement, but provided a larger buffer between their power lines and his property, making his land more valuable.

It would be recorded in the county recording off (Register or Clerk) where the property is located. It should have been in the title report ordered by your attorney or title agent when you bought the property. The only way to remove it is if the utility company would agree, e.g. if they no longer use it or have abandoned it.

The easement will show in your title report that was prepared for you and your lender prior to purchase. You should have filed it with your title insurance policy.
