Does an email/fax constitute a legal partnership

Emailed/ Faxed my father a letter stating this is the property we will be going in on, and I need a partner. We never signed or agreed on anything verbally. He sent me money to do it then 1 week later said he did not want to be a coowner due to his 2nd divorce and told me to do it without him. I did. That was in NOv 1999, now feb 2002 he is trying to sue me in chancery division for 1/2 of the property. He claims the email/fax and the fact he sent me money ( A cashiers check with no notation what it was for) is fact enough there was a partnership. Where was he for 2 years when I spent 75,000 to improve the property?

It seems to me that if you used his money, he may have a point. On the other hand, deals involving land usually require a writing. You need to immediately seek legal advice.
