Need to evict my tennent!!

Hi. My question to you is this...I have a tennent who is on a mounth to mounth rental with a mounth to mounth lease. There was a fire in one room of her apartment witch they were at fault. So now reconstruction has started and she has not paid her rent yet this mounth, we are almost into next mounth. They say they will not pay till they can use the dammaged room. We want them OUT! Also my sister needs to move in. Is it true that if a family member is moving in then they must leave. 30 days notice should be good? Thank you.

You can terminate the lease for a family member. Also, they must have broken the lease by allowing the fire to have taken place. Send them an eviction notice - 30 days, and proceed with Court if they do not comply. Be sure you have verification that their negligence was responsible for the fire. Did you make a claim for them to make the repairs caused by their negligence? If not, do so also.
