Legal Question in Real Estate Law in New Jersey

I am the executor of a house that belonged to my cousin who had a roommate. The roommate won't leave even though she doesn't pay any rent. I need to sell the house to pay the mortgage.

The roommate has the status of a tenant even though she doesn't pay rent. You cannot lock her out or force her to leave. The police will not help. You must file a landlord/tenant suit to have her evicted. Fortunately, this does not take very long and it is not very costly. The sooner you start, the better. If the house is located in south Jersey, I can help. I do business litigation all over New Jersey but this is a small matter. If the house is near you, you should look for a lawyer who does landlord/tenant work there.

I am not sure if person occupying is actually considered a tenant, as there is no lease and no rent is being paid. By what authority is person considered a tenant? I agree that you need Court intervention to evict the person. This is best done by retaining an attorney who handles this type of litigation.
