Legal Question in Real Estate Law in New Jersey

False advertising by real estate agent

I paid a realtor fee to a realtor co. to helpme find an apartment. I said not to go above 900. I was told by the realtor that the apartment he found for me was 900. I paid the 900 fee and set a date with him to come in to sign the lease and move in. On the day that I moved in I drove from MA to NJ with all of my stuff. I went first to the realtor to sign the lease and there he said he made a mistake, the rent was really 950. I had to sign the lease,I had no where else to go since he told me on the day I moved in and I turned down another apart. 5 days before since he told me I was all set to have this 900 apt. the lease said both parties could terminate with 60 days. My realtor admitted that he knew the price of the lease was 950 5days before I moved in,he never answered when I asked why he didn't tell me before. The realtor fee I paid was good for a year so he still is supposed look for a new apartment for me. But they are trying to tell me that they are doing me a favor by trying to talk to the owner of the apartment into bringing the price down to 925. I want the realtor to start looking for another apartment for me but they are giving me a hard time about this.

Re: False advertising by real estate agent

If you have the agreement with the broker in writing, you can sue for misrepresentation. Also, write a complaint to both the Better Business Bureau and the State Board of Realtors. You are entitled to a refund of your fees and maybe the rent differential as well, plus the cost of a second move, if required.
