Legal Question in Real Estate Law in New Jersey
A false lien filed against my townhome
My wife and I received a letter stating that we were in default of our association fees and special assessments. We received a notice of lein in the mail that was filed with the county. The problem? We have been paying all obligations on time, and have the bank statements to prove it! Also, it appears that the lien was supposed to be put on another unit ''52'' instead of ''72'', but now the damamge is done! What recourse do I have? We have all back-up documentation to prove our case...the Association and the attorney really screwed this one up, and we are suffering.

Re: A false lien filed against my townhome
Write a letter to the Association with copies of your evidence and ask it to correct the situation by removing the lien from your property. Send the letter by Certified Mail Return Receipt Requested, and also by regular mail.
If the Association refuses, you will probably have to get a lawyer to assist you in removing the lien.
This response is not legal advice, since I do not have all of the information that would be required, and I do not have a representation agreement with you.
* If the answers to your question confirm that you have a valid issue or worthwhile claim, your next step should almost always be to establish a dialog with a lawyer who can provide specific advice to you. Contact a lawyer in your county or township.
* Another reason for contacting a lawyer is that it is often impossible to give a good answer in the Internet Q&A format without having more information. The unique circumstances of your situation and things that you may not have thought to mention in your question may completely change the answer. If you want to be sure that you have a complete answer to your question and an understanding of what that answer means, establish a connection with a lawyer who practices in the area of your concern.
