Legal Question in Real Estate Law in New Jersey

fence problems

I purchased a home in New Jersey in Jan of 2007 and I have just found out that the fence that was already installed at the time of purchase is on my neighbor land by two feet. The fence has been on thier land for at least three years. My question is what is the law on the fence? Do I have to move it or tear in down. Or can I just say ''hope you like your fence''. I have title insurane, but I not sure if that will help here at all.

There are a lot of variations on this theme. The first question is how do you know that the fence is on your neighbor's land? Is there a survey that shows that? Is there a survey that shows something else? Do the deed and the survey agree?

If you were a cautious buyer, you had a lawyer represent you at settlement. (The buyer always should.) In that case, give that lawyer a call and find out what he or she thinks. otherwise, find a lawyer to review what you have.
