Legal Question in Real Estate Law in New Jersey
fencing a commercial property
are there any laws to enforce a commerical property owner to put up a fence between his commercial property and next door residential property? There is a transmission garage next to my property, he has many cars in the lot next to me which is an eye sore, and he parks them on the road off a highway which is a blind corner when you come off the highway, which may be an accident waitng to happen. can i make him put up a high fence between our properties?

Bob is correct that this requires a zoning law interprtation. In many instances some barrier is required as part of the site plan approval. However, you provide no facts on how long the business has existed, who was there first (you or he), if there were zoning restrictions in place which he might not have complied with (like creating the barrier), etc. If this is a real safety problem, you might contact your local police so see what they might recommend. More facts are needed to provide a more than general reply.

the answer to this will depend on the local zoning ordinance, the location and layout of the business, and maybe on other factors as well.
