Flood damage
We sold our home over a yr. ago, the new owners got flood damage are we responsible?

Although litigation is complicated, and many other issues may arise regarding material disclosures to the buyers of your home, the initial answer to your question is no. When you sell your home, you pass the responsibility to the new owner and you should not be liable for the damage after sale. If you have any further questions, please contact this office.

The answer depends upon what disclosures you made or withheld when you sold the house, if you were aware of a potential flooding condition and did not disclose it, if they conducted a home inspection and, if so, what the report disclosed. The probable answer is no if you made no false disclosures or representations and were not aware of the condition. You should be aware that anyone can start a suit, but that does not mean they will be successful.
