Legal Question in Real Estate Law in New Jersey

foreclosure company problem

Good Evening,

My sister was in foreclosure in 2006. (The property is in South Plainfield, NJ)

We contacted a foreclosure company that did the following :

1. they paid the foreclosure amount

2. added their fee

3. produced a contract that gave us one year to acquire the property back and

4. we were to pay the rent per the contract.

The contract ended in November 2007. Since then we have paid the rent they asked. There were months that we were late, but we always paid each month including the late fee.

They have, now, terminated the lease. We have to be out by May 31st.

What can we do?!?!?

Thanks.

Re: foreclosure company problem

This common scan or fraud has become very popular recently, with the mortgage problems everywhere.

Unless this company has gotten a court order requiring you to move and given you a copy of the order, you may stay in the home. You may want to call the court to verify that the order is valid. There may still be time to contest that order.

You need to consult with a real estate lawyer in your county who is familiar with these foreclosure "saving" schemes and who also handles litigation. Do this as quickly as possible, so that you get the help you need.
