Legal Question in Real Estate Law in New Jersey
foreclosure
Received a civil action summons from mortgagor's attorney. It says I must answer in writing a answer or motion w/ a completed Case Information Statement within 35 days. I now have 6 days left and I don't know how to do it. Can you help? I have recently applied to the Chase Homeowner's Assistance Program for a refinance. I am in review there and would like to stop foreclosure proceedings to arrange for a refinance. I do not want to lose my home.

Re: foreclosure
It is imperative that you retain an attorney immediately. Your failure to timely answer the complaint, could result is the entry of a judgment of foreclosure by default.
Let me know if I can be of further help.

Re: foreclosure
You must answer the Complaint in the prescribed time period or else you will be deemed to be in default.
If you intend to represent yourself, call the attorney noted on the Summons/Complaint and tell him/her that you need a 30 day extention, then get some legal help composing an Answer.
However, I strongly recommend that you hire counsel and therefore suggest you bring the Summons and Complaint to a local attorney -immediately. Do not ignore this.
(I presume by "mortgagor's attorney", you mean the bank's or lender's attorney. In point of fact, you are the mortgagor and the lender is the mortgagee.)
Good luck,
