Legal Question in Real Estate Law in New Jersey
(Fraud) with no one to help
I am a victim of real estate fraud, where my home was taken via a person who was supposed to have been a refinancing officer of this company. As it turned out he was not, and the next day, he filed and recorded a deed on my property in his 18 year old nephew's name. The nephew name was used to sell the property using a strawbuyer in another state for the price of $100,000.00. All was filed and recorded in the county. There was an existing mortgage on the property during these transfers. The strawbuyer then puts another mortgage on the property in the amount of $99,000.00. The bank was in on the scam, and the strawbuyer gave the bank a lieu in forclosure on my property. I was alerted to what had occurred and obtained an attorney, but the court knowing it was wrong, gave my property to the bank, and forced me and my family out. The court said it was wrong, but because there were lawyers and a judge involved no one wanted to help pursue the case. I went to court, but was to no avail. I live in New Jersey, and the courts are aware of what is going on in this state, but no one wants to admit it. A judge who was asked what was going in my case, said that since none of the courts did anything about it, he shouldn't either.. GREAT SYSTEM

Your situation is complex and unclear. I understand your strong feeling that the system has failed you. You need to bring ALL of the documents having anything to do with this matter to an attorney who handles real estate and handles lawsuits. You need a careful review and analysis by an attorney, to guide you. This is likely to take some time. Do not be surprised if any qualified attorney charges you for the attorney's time.
