Legal Question in Real Estate Law in New Jersey
Guardianship vs Temporary Custody
I am caught between family obligations and a relationship with a very decent (for the most part) landlord. My sister is going through some problems and will probably be evicted from her apt in Englewood. It would be a terrible imposition for both her and my nephew to stay with me and my family. I live in a 2 bedroom/2 bathroom apt with my son and husband. Until she finds another apt, she would like to send my nephew to live with me in Hackensack and go to school here. However, after explaining the situation to my landlord, he does not want to allow him and will not sign an affidavit confirming his residence. We were initially considering temporary custody, but that would require the affidavit from my landlord. If my sister assigns guardianship to me, would he then be considered a resident of the town? Our main concern is registering him for school.

Re: Guardianship vs Temporary Custody
Your landlord may not like it, and it does not seem that you can make that landlord happy. But you should be able to do what is best for the child, with a little legal advice.
Is your sister going to be able to solve her problems anytime soon?
