Legal Question in Real Estate Law in New Jersey
''guest'' won't leave
I inherited my mom's duplex several years ago. My step dad had no where to live so I have let him stay there since. He eventually let a woman 40 years younger than him move in with him, as well as her mother and son. The house has been totally destroyed. He moved to another state without telling me or his ''guest'' and she says she has no where to go.there is no lease, and he basically abandoned her there. I gave her one week to vacate the apartment, in writing, which she acknowledged by signing.now she says she has no money and says my step dad just left her there. i do not see this as my problem. i consider her a tresspaser. I told her to go to where he lives now and knock on his door, or move in with her mom, in the PA home. how do I get rid of her? I have a contractor coming in one week to begin renovations. i also told her to apply for rental assistance.

Re: ''guest'' won't leave
The fact is that she is a trespasser and the police should remove her if you ask. However, because of confusion with certain protections for tenants, the police often defer to the Landlord/Tenant court. So, you may have to have her evicted.
You do not want her to apply for rental assistance while she occupies your property. She may get it and the court may feel obligated to let her stay.

I can help you file in landlord tenant court to have them removed.
That really is the only way to go (legally) since they have been residing there...if you want to try other ways, they may come back to bite you.
