Legal Question in Real Estate Law in New Jersey

Home owner responsibility

I am looking to separate from my husband and want to know if I am responsible for the house if my name is on the deed and is it considered abandonment if I leave before the house is sold.

Thanks

Re: Home owner responsibility

All persons on the deed are responsible for its upkeep and maintenance. In a divorce/separation context, just because one party leaves the home does not mean he/she has abandoned all rights or obligations to the home. This would need to be determined by agreement or by Court order. Keep in mind that this advice is given based on very limited facts.
